General terms and conditions of RS installatiegroep BV filed with the Chamber of Commerce in Eindhoven

1. Applicability
1.1 These conditions apply to all quotations, agreements and services of RS installation group BV (KvK 98097466).
1.2 Deviations are only binding if agreed in writing.
1.3 General terms and conditions of the customer are excluded unless otherwise agreed in writing.
2. Offers and Agreements
2.1 All quotations are without obligation unless expressly stated otherwise. Costs may vary up to 20% due to unforeseen circumstances.
2.2 An agreement comes into effect after written or e-mail confirmation by RS installatie-group BV, or as soon as implementation has started.
3. Prices and Payment
3.1 Prices are exclusive of VAT unless otherwise stated.
3.2 Business customers: payment within 30 days. Private customers: payment within 5 days, unless otherwise agreed.
3.3 In case of late payment, statutory interest and collection costs shall be due.
3.4 RS Installation Group BV may require a down payment or payment in instalments. Work shall only start after payment.
3.5 Material costs may be invoiced in advance.
4. Performance of Work
4.1 RS Installation Group BV shall carry out the work professionally and competently.
4.2 Third parties may be engaged if necessary.
4.3 The customer shall provide timely access and necessary information.
4.4 The workplace should be safe and tidy according to the HSE.
4.5 Delays due to negligence on the part of the customer shall be at the customer's expense. RS Installation Group BV works according to the VCA guidelines and is VCA certified.
4.6 The customer shall provide suitable dining facilities and access to a toilet and washroom.
4.7 RS Installation Group BV works according to the SCC guidelines and is SCC certified.
4.8 When replacing or modifying the group box/distribution box, we are not liable for faults etc. of the descending groups.
5. Changes during the Assignment
5.1 Changes during execution shall be agreed in writing if the additional costs exceed €200 excluding VAT.
5.2 Additional work will be invoiced separately according to the applicable rates.
6. Completion and approval
6.1 Upon completion, RS installation group BV shall report that the work has been completed.
6.2 The customer must indicate in writing or by e-mail within 2 working days whether the work has been approved.
6.3 If there is no response, the work shall be deemed approved.
7. Liability
7.1 RS installation group BV is only liable for direct damage caused by intent or gross negligence.
7.2 Liability is limited to the amount paid out by insurance, or otherwise to the invoice amount.
7.3 No liability for indirect or consequential damages.
7.4 Restrictions do not apply to the extent contrary to mandatory consumer law.
5. Warranty
8.1 There is a 12-month warranty on work carried out, unless otherwise agreed.
8.2 Warranty lapses in case of modifications by the client without the written consent of RS installation group BV.
9. Force majeure
9.1 RS installation group BV is not liable in the event of force majeure.
9.2 Force majeure includes strikes, traffic, delivery problems, government measures and natural disasters.
10. Suspension and Dissolution
10.1 RS Installation Group BV may suspend performance or dissolve the agreement in the event of default by the customer.
10.2 This does not affect the right to damages.
11. Transport and waste
11.1 The customer shall provide vertical transport unless otherwise agreed.
11.2 Disposal of waste and debris are at the customer's expense unless otherwise agreed. Customer shall provide waste container(s).
12. Applicable law and disputes
12.1 Dutch law shall apply.
12.2 Disputes shall be submitted to the competent court in the place of business of RS installatie-groep BV.
13. Consumer rights (for private customers only)
13.1 In the case of distance selling, a withdrawal right of 14 days applies unless execution on demand is started.
13.2 Consumer rights apply in accordance with legal protection.
13.3 In case of contradictions, consumer law shall prevail for private customers.
